Our client suffered fractured ribs and bruising in a tractor trailer collision that flipped her car, and she was sent home after a few days in the hospital. About a month later, she was returning to her previous level of physical activity, and she noticed pain in her right knee that had not been diagnosed. The insurance settlement had not yet been settled, and she went to see another doctor about her knee. It was determined that our client’s knee had been fractured, and upon securing the x-ray taken for other injuries following the collision, it became clear that the original doctor had not identified the fractured knee. Due to the delay in addressing this injury, it could not be repaired as it could have been if treated immediately. Two surgeries would be required. We secured a medical malpractice settlement and a larger insurance settlement, which combined to compensate our client for her injuries.
